Do workers’ compensation claims impact tech staffing firms?
Claims themselves typically don’t have a major impact – but coverage availability absolutely does. Many carriers in our program only insure IT and engineering staffing. If you try to expand into medical, industrial, or other sectors, we may not be able to provide coverage due to carrier restrictions.
Important: Before you diversify your business into new verticals, speak with your insurance agent to confirm they can continue to insure you. We’ve had clients sign contracts for roles we couldn’t get covered. Don’t let that happen to you.
What does "Claims Made" coverage mean?
A claims-made coverage in insurance provides coverage for claims that are first made (reported to the insurer) during the policy period, regardless of when the incident that triggered the claim actually occurred. This contrasts with occurrence-based policies that cover incidents that happen during the policy period, even if the claim is filed later.
With claims-made policies, a claim must be reported while the policy is active to be considered for coverage, even if the event occurred earlier. Once your policy expires or is cancelled, future claims won’t be covered unless you have purchased extended reporting or “tail” coverage.
Why is diversification into other industries (like healthcare or industrial staffing) a challenge?
The TechServe Business Insurance Program is tailored to IT and engineering staffing. Carriers often have strict exclusions for other industries due to higher risk profiles. Even when coverage is possible, premiums can jump dramatically (e.g., from $2,000 to $10,000–$25,000 minimums).
What is Crime Coverage, and do I need all types?
Yes – ideally. There are two types of crime coverage:
- Third Party Crime: This provides coverage for your client from theft or forgery committed by your employee. This is often contractually required.
- First Party Crime: This coverage protects a business from financial losses resulting from criminal acts committed against it, such as employee theft, fraud, or forgery. Essentially, it covers losses incurred directly by the policyholder due to crime, as opposed to third-party coverage, which covers claims made against the policyholder by others.
Most clients carry only what’s contractually required (usually third party), but we strongly recommend full crime coverage – it’s more likely your business will be targeted by external threats than internal theft.
What’s the difference between General Liability and Professional Liability?
General liability insurance and professional liability (also known as Errors and Omissions or E&O insurance) are distinct types of insurance that protect businesses from different types of risks.
- General Liability: Covers bodily injury, property damage, and other “slip and fall” type claims.
- Professional Liability (a.k.a. Errors & Omissions): Covers financial losses resulting from errors, omissions, or negligence in professional mistakes, or failure to deliver services.
Tech and engineering staffing firms typically are required to carry both.
What does EPLI (Employment Practices Liability Insurance) cover?
EPLI protects your business from employee-related lawsuits alleging:
- Wrongful termination
- Discrimination
- Harassment
- Retaliation
It covers legal fees, settlements, and judgments – critical protection in today’s employment environment.
What does D&O (Directors and Officers) coverage do?
D&O insurance, or Directors and Officers insurance, protects your company’s directors and officers from personal liability if they’re sued over decisions made in their roles. Primarily, it covers legal fees, settlements, and other costs associated with lawsuits alleging wrongful acts by a company’s directors and officers.
These “wrongful acts” can include a wide range of actions, such as breach of fiduciary duty, misrepresentation of company assets, misuse of funds, and failure to comply with workplace laws. Essentially, it protects the personal assets of these individuals, as well as the company itself, from financial loss due to such claims. This is especially important if you have investors, a board, or external scrutiny.
Does Umbrella insurance extend over Crime or Professional Liability?
No. Umbrella policies typically extend over General Liability, Auto, and Employers Liability – but not over Crime or Professional Liability policies.

Do your policies provide coverage for work done in Canada?
Most policies in our program will cover work in the U.S. for a Canadian company, but not if work is being done in Canada. Always check your specific policy terms or ask your agent anytime work is being performed outside the US.
What is Social Engineering Fraud (also known as False Pretense)?
This covers fraudulent financial transfers caused by deceptive emails or communications. For example, a hacker may impersonate a client and request a change in payment instructions – resulting in a wire transfer to a fraudulent account.
This is sophisticated fraud – and not all policies offer this coverage. Ask your agent about adding it to your policy.
I don’t have company vehicles - why do I need Hired & Non-Owned Auto (HNOA)?
If an employee drives their personal vehicle or a rental for work purposes, your business can still be held liable in an accident. Using rented, hired or personal non-owned vehicles for work-related purposes exposes your business to risks. HNOA covers that gap and protects you from potentially devastating liability lawsuits.
Can I cancel my policy if I no longer need it?
Yes. However, cancellations are subject to short-rate penalties for unearned premiums.
If your policy is claims-made, you’ll also lose your retroactive date, which could leave you exposed to past claims — uncovered claims originating in the past, but presented after the policy is cancelled.
