Member-to-Member Partnering Platform

To encourage the broadest participation, we have developed a series of common sense rules to govern the conduct on the Deal Center platform. The essence of these rules is simple and reflect the principles embodied in “The Golden Rule” (i.e. treating others as you want to be treated).

  1. What happens on the Deal Center, Stays on the Deal Center.
    1. Any information gleaned from the Deal Center platform should only be used to evaluate and respond to opportunities through the Deal Center in accordance with its rules. Information posted on the Deal Center should not be used in any other setting or for any other reason.
    2. No participant may use information posted on the Deal Center to engage with a client or candidate with whom the participant did not have a preexisting relationship. If you learn of an opportunity or candidate through another participant on the Deal Center, you may not contact the prospective client or candidate directly without the express permission of the firm that posted the opportunity or submitted the candidate.
    3. No participant may disclose information learned through the Deal Center platform to third parties who do not have access to Deal Center.
  2. All postings and submissions must be made in good faith
    1. You may not post openings or submit candidates that are speculative. You may only post job opportunities for openings where you have an ongoing contractual relationship with the end client and to best of your knowledge an actual opening exists. Likewise, you may only submit the credentials for one or more specific individuals you know are available for assignment or placement, you have the candidate’s permission to submit their qualifications and they substantially meet the requirements of the posting.
    2. If two or more firms submit the same successful candidate to a posting, the first firm to submit the candidate shall be recognized as the submitting firm unless otherwise directed by the candidate.
    3. If a candidate is on an H-1B visa, the firm submitting the candidate must be both a TechServe Alliance member and the actual sponsoring employer (i.e. holding the visa)—submission of a candidate sponsored by an unrelated firm, a subsidiary or affiliated entity of the TechServe member is not allowed.
    4. You may not submit unsolicited candidates outside of the Deal Center platform unless explicitly requested to do so by the other firm.
    5. If a firm asks you to no longer submit to candidates for their postings or to cease contact, you must immediately honor that request.
  3. All participants must abide by all federal, state and local laws, including but not limited to those listed in the TechServe Alliance Statement of Business Principles:
    1. Adhere to the tenet of equal opportunity regardless of race, religion, color, sex, creed, age, marital status, sexual orientation or national origin.
    2. Adhere to the principles of free and fair competition and do not do not engage in illegal restraint of trade, unfair competition or violation of antitrust laws.
    3. Do not defame clients, consultants or competitors.
    4. Preserve all confidential and proprietary information relating to both clients and consultants.
    5. Do not intentionally misrepresent a consultant’s skills or experience.
    6. Do not misrepresent a consultant’s pay rate, contract terms, assignment duration, or aspects of a potential engagement.
    7. Do not demand unreasonable non-competition clauses or unfairly prevent a consultant from pursuing other opportunities.
    8. Do not induce consultants to breach or improperly interfere with a contractual relationship.
  4. All parties must act in good faith and abide by the terms of any agreement made between the parties.
  5. All parties must abide by the Gustav’s and the Deal Center’s Terms of Use which may be amended from time-to-time in Gustav’s and TechSeve Alliance’s sole discretion.
  6. TechServe Alliance reserves the right to terminate a firm’s participation in the Deal Center at any time in its sole discretion for any reason including for any violation of these rules, which may be amended from time-to-time.
